Can you sell a house with a tenant in it in Florida?

Yes. The first step is checking what kind of lease you have, because that decides how much notice you give and when the home can be empty.

For a month-to-month tenant, Florida requires at least 30 days' written notice before the end of a monthly rental period. A fixed-term lease, like a 12-month lease, generally continues until its end date unless it allows early termination or the tenant agrees to move sooner. Many owners and tenants simply work out a move-out plan together and put it in writing.

Start With the Lease

Which Lease Do You Have?

Month-to-Month

30 days' written notice

Give written notice at least 30 days before the end of a monthly rental period. This has been Florida's rule since July 2023.

Fixed-Term Lease

The lease runs to its end date

Selling doesn't cancel it. It ends on schedule unless the lease allows early termination or the tenant agrees to leave sooner. If your lease requires a non-renewal notice, it must be 30 to 60 days.

Need more flexibility? If your tenant needs a little more time, or you'd both like a different date, you can agree on your own move-out plan. Just put it in writing.

People First

Working With Your Tenant

A sale goes smoother when your tenant is treated with respect and kept in the loop. Here's how I handle it. Tap a card.

From My Experience

A Tenant-Occupied Sale in Pensacola

I listed and sold a home in Pensacola that had a tenant living in it. The owner needed it sold, and the tenant needed a smooth, respectful transition.

I stayed hands-on from start to finish, and the home sold.

What I Handled

  • Coordinated directly with the tenant from day one
  • Helped her find another place to rent
  • Coordinated getting the home ready for sale
  • Coordinated the move-out of her belongings
  • Kept the owner updated through every step

Have a Property Manager?

Working With Your Rental Management Company

If a management company handles your rental, I work directly with them, so you're not stuck relaying messages between everyone.

Check the management agreement

Some agreements require notice before you sell or end their services. I review the timing with you so it lines up with your sale.

Tenant communication

We agree on who tells the tenant what, and when, so the tenant hears one clear, consistent message.

Showings and access

I coordinate keys, lockbox access and showing schedules with the manager and the tenant.

Move-out and the deposit

I stay in touch with the manager on the move-out inspection and security deposit, so the home is ready to list right away.

Your Boots on the Ground

Many landlords here bought while stationed nearby and now live somewhere else. You don't have to fly back to sell.

Realistic Expectations

A Typical Timeline

Step 1

Review the lease

We confirm whether it's month-to-month or fixed-term and what notice it requires.

Step 2

Notice and a move-out plan

At least 30 days for a month-to-month tenant, or the lease end date for a fixed-term lease, unless you agree on something different in writing.

Step 3

Prep once it's empty

Usually one to two weeks for repairs, cleaning, staging, photos and video.

Step 4

List, accept an offer and close

A financed buyer commonly takes about 30 to 45 days to close after you accept an offer. Cash can be faster.

At Closing

Deposits, Rent & the Details

If the tenant has moved out

Handle the security deposit under Florida's rules: return it within 15 days, or send written notice of any claim within 30 days of move-out.

If the tenant is staying

When you sell to an investor with the tenant in place, the security deposit and current month's rent are typically credited to the buyer at closing.

Taxes on a rental sale

Selling a former rental can have different tax rules than selling your home. Ask your CPA before you list.

Good Questions

Selling a Rented Home: FAQ

How much notice do I have to give a tenant to sell my house in Florida?

For a month-to-month tenant, at least 30 days' written notice before the end of a monthly rental period. For a fixed-term lease, the lease generally runs to its end date unless it allows early termination or the tenant agrees to move sooner.

You and your tenant can always agree in writing on a different move-out date.

Does a lease end when the house is sold in Florida?

No, not on its own. A buyer generally takes the home subject to the existing lease, so the tenant can stay until the lease ends unless the lease or a written agreement says otherwise.

Can I show my house while the tenant is still living there?

Yes, with reasonable advance notice. Florida allows a landlord to show the home to prospective buyers, and I schedule showings around the tenant's routine so it stays respectful and the home looks its best.

Should I sell with the tenant in place or wait until it's empty?

An empty home is usually easier to prepare, show and sell to the widest pool of buyers, including those using VA and other financing. Selling with a tenant in place mainly appeals to investors. We'll compare both for your home.

Can I sell my rental house from out of state?

Yes. I coordinate with your tenant or property manager, handle the in-person work at the home and keep you updated. Documents and closing can be signed remotely.

Do I need to tell my property management company before I sell?

Yes, it's a good idea to talk with them early. Many management agreements have their own notice requirements for ending services or selling. I can work with your manager directly on notice, showings, access and the move-out.

What happens to the security deposit when I sell?

If the tenant moves out, you handle the deposit under Florida's rules: return it within 15 days, or send written notice of any claim within 30 days. If the tenant stays, the deposit is typically credited to the buyer at closing.
